Norco Industries Claims Victory in Patent Infringement Case, Reports Fulwider Patton LLP

Monday December 18, 9:05 pm ET

--(BUSINESS WIRE)--Fulwider Patton LLP's trial team, headed by Vern Schooley, defeated Motorvac Technologies, Inc.'s challenges to Norco Industries, Inc.'s patent infringement victory, proving damages and willful infringement that has led to a doubling of Norco's proved damages plus attorney fees.

Motorvac initiated a lawsuit in May 31, 2002 by filing a complaint against Norco for patent infringement of an automatic transmission fluid exchange device. In the course of the litigation, Fulwider invalidated Motorvac's patent and secured a summary judgment of infringement against Motorvac. The company appealed Norco's victory to the Federal Circuit Court of Appeals, but it was swiftly denied, and on December 1, 2006, Motorvac satisfied the judgment.

The Federal Circuit Court of Appeals on November 8, 2006 affirmed the award by Judge David O. Carter of the Central District of California in the amount of $2.4M, including an award of Norco's attorney fees. Norco CEO, Andrew Tallman, saluted the Fulwider litigation team for successfully turning the tables on Motorvac, calling the decision a complete victory for Norco.
